New start for Wheeler trials

UC Berkeley has agreed to grant pro-Palestinian protester Roberto Hernandez a new student conduct hearing, acknowledging concerns about the legality of UC police videos, reports and testimony used in his current hearing. 

But it was unclear, at press time, how UC Berkeley will modify the evidence it presents in the new hearing. Hernandez’s lawyers want police reports, videos and testimony excluded entirely, but the university left open the possibility that it will use parts of videos and reports. 

With uncertainty about the evidence lingering, Hernandez, who took part in the April 9 takeover of UC Berkeley’s Wheeler Hall, remained skeptical. 

“The first hearing was done very unjustly,” he said. “I still have my worries about whether the new hearing will [be any better].” 

Hernandez is one of 79 students and community activists who occupied Wheeler in April, demanding that the nine-campus University of California divest from Israel.
